Terms of Service

1. Agreement to terms

By using this website or purchasing any service from Kirk Copywriting, you agree to be bound by these Terms of Service. If you do not agree, do not use the site or place an order.

2. Services

Kirk Copywriting provides professional copywriting and content strategy services including, but not limited to: website copy, sales pages, email sequences, brand messaging, content strategy, and launch copy. All services are delivered digitally. No physical goods are sold.

Service specifications, deliverables, and timelines are confirmed at the point of purchase or during the project kick-off process. Any additional scope agreed during a project will be documented and priced separately.

3. Placing an order

To place an order, you must: (a) be at least 18 years old or have the authority to bind the company you represent; (b) provide accurate billing and contact information; (c) agree to these Terms and the applicable Refund Policy.

An order is confirmed upon receipt of full payment. Kirk Copywriting reserves the right to decline any order at its sole discretion, in which case a full refund will be issued.

4. Pricing and payment

All prices are displayed in Euros (EUR) and include applicable taxes. Prices are as listed at the time of purchase. Kirk Copywriting reserves the right to update pricing at any time; changes do not affect confirmed orders.

Payment is processed by Stripe Inc. and is subject to Stripe's terms and privacy policy. Kirk Copywriting does not store card details.

5. Delivery

Delivery timelines are set out in our Delivery Policy. We make every effort to deliver on time. If a delay occurs due to circumstances within our control, we will notify you promptly. Delays caused by late client feedback or incomplete brief information are not within our control.

6. Revisions

Each package includes a specified number of revision rounds as described on the relevant service or pricing page. A revision round is one consolidated set of feedback delivered at one time. Piecemeal or sequential feedback may count as multiple revision rounds. Revisions beyond the included amount are charged at our standard hourly rate of €31.80/hr.

7. Client responsibilities

You agree to: provide accurate, complete, and timely information needed to complete the project; respond to requests for feedback within reasonable timescales agreed at kick-off; and have the right to use any material, images, trademarks, or information you provide to us.

You are solely responsible for ensuring that the final copy, as published, complies with applicable laws, regulations, and platform terms in your jurisdiction.

8. Intellectual property

Upon receipt of full payment, Kirk Copywriting assigns all rights in the final delivered copy to the client. Kirk Copywriting retains the right to display anonymised or client-approved extracts as portfolio samples, unless the client requests otherwise in writing.

Drafts, notes, and working documents remain the property of Kirk Copywriting and are not transferred.

9. Confidentiality

Kirk Copywriting treats all client information as confidential and does not share it with third parties except as required to deliver the service (e.g., payment processors). This does not affect our right to reference the client relationship in general terms (e.g., "we've worked with clients in the hospitality sector").

10. Limitation of liability

Kirk Copywriting is not liable for indirect, incidental, or consequential damages arising from the use of our services, including lost revenue, lost business, or missed launch targets. Our total liability for any claim is limited to the amount paid for the relevant project.

We do not guarantee specific conversion rates, revenue outcomes, or search rankings as a result of our copywriting services. Copy is one element of a marketing system; results depend on many factors outside our control.

11. Governing law

These Terms are governed by the laws of Portugal. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Cascais district, Portugal, except where mandatory consumer protection laws in your country require otherwise.

12. Changes to these terms

We may update these Terms at any time. The version published on this page at the time of your order governs that transaction. Material changes will be communicated to active clients.
